The offers on this website represent a non-binding invitation to the customer to order products and/or services from Quail Flavours GmbH. By placing an order on this website and accepting these GTC, the customer makes a binding offer to conclude a contract. King Quail Flavours GmbH will then send an automatic "order confirmation" by e-mail, which confirms that the customer's offer has been received by Quail Flavours GmbH. Orders placed are binding on the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract comes into effect as soon as Quail Flavours GmbH sends a declaration of acceptance by e-mail confirming the dispatch of the ordered products or services.
Orders are only delivered after full payment has been received (exception: delivery against invoice) and as far as the goods are available. If it becomes apparent after the conclusion of the contract that the goods ordered cannot be delivered or cannot be delivered in full, Quail Flavours GmbH is entitled to withdraw from the contract in whole or in part. If the customer's payment has already been received by Quail Flavours GmbH, the amounts paid will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. Quail Flavours GmbH is not obliged to make a replacement delivery in the event of withdrawal from the contract.
The customer has the methods of payment specified in the order procedure.
Quail Flavours GmbH reserves the right, without being obliged to give reasons, to refuse a customer a particular method of payment or to demand payment in advance.
After expiry of the aforementioned payment period, the entire invoiced amount is due, and the customer is automatically in default of payment without any notice of default.
In the event of default in payment, Quail Flavours GmbH may commission a collection company in Switzerland or abroad or assign the claim.
If the customer is late, interest on arrears of 14.9% p.a. and a reminder fee of CHF 20 per reminder may be levied.
If, in the event of arrears, a third party is commissioned to collect the amounts due, additional fees and costs may be charged in accordance with the tariffs of the Swiss Association of Collection Companies (VSI) (http://www.vsi1941.ch). The customer expressly agrees to this.
The products delivered to the customer remain the property of Quail Flavours GmbH until full payment has been made.
Deliveries are sent by post or express courier to the address given by the customer in the order. Invoicing is carried out by e-mail or by post. The use and risk are transferred to the customer at the time of shipment, insofar as this is permitted by law.
If the delivery cannot be delivered or if the customer refuses to accept the delivery, Quail Flavours GmbH is entitled to withdraw from the contract and to charge the customer for his expenses after sending the customer a reminder by e-mail and setting an appropriate deadline.
The customer is obliged to inspect the delivered goods immediately after receipt of the delivery and to report any defects, for which Quail Flavours GmbH provides a guarantee in writing without delay by post or e-mail to the address given in the imprint.
Returns to Quail Flavours GmbH are made at the customer's expense and risk. The customer must send the goods in their original packaging, complete with all accessories, the delivery note and a detailed description of the defects, to the return address given by Quail Flavours GmbH in the legal notice.
If, upon inspection by Quail Flavours GmbH, it is found that the goods have no verifiable defects or that the defect is not covered by the manufacturer's warranty, Quail Flavours GmbH can charge the customer for the inconvenience, return shipment or possible disposal.
The customer has a right of revocation of 14 calendar days from receipt of the goods. This period is deemed to have been observed if the customer has sent a written revocation by e-mail (info@kingquailflavours.com) or by post to Quail Flavours GmbH (King Quail Flavours GmbH, Birseckstrasse 10, CH-4059 Basel) within this period. No reason is required for the revocation.
The exercise of the right of revocation leads to the cancellation of the contract. The customer must return the goods within 14 calendar days in their original packaging, complete with all accessories and the delivery note, to the return address of Quail Flavours GmbH (King Quail Flavours GmbH, Birseckstrasse 10, CH-4059 Basel). Returns to Quail Flavours GmbH are made at the customer's expense and risk. Any payments already made will be refunded to the customer within 20 calendar days, if Quail Flavours GmbH has already received the goods or if the customer can provide proof of shipment.
Quail Flavours GmbH reserves the right to demand appropriate compensation in the event of damage, excessive wear and tear or loss of value due to improper use, and to deduct the reduction in value from the purchase price already paid or to charge it to the customer.
No right of withdrawal is granted in the following cases:
(I) If the contract contains an element of chance, i.e. the price is subject to fluctuations over which the supplier has no influence.
(II) where the contract relates to goods which by their nature are not suitable for return or may spoil quickly
(III) where the subject of the contract is goods made to the consumer's instructions or clearly tailor-made for personal requirements
(IV) if the contract relates to digital contents and these contents have not been made available on a fixed data carrier or if the contract must be performed in full without delay by both parties to the contract;
(V) where the contract has as its object a service and the contract is to be performed in full by the supplier with the consumer's prior express consent before the withdrawal period has expired;
(VI) in the fields of accommodation, transport, food and drink and leisure, where the supplier undertakes at the time of conclusion of the contract to provide the services on a specific date or within a specific period.
The sale of alcoholic beverages to persons under the age of 16 and the sale of spirits to persons under the age of 18 is strictly prohibited by law in Switzerland. By placing an order on www.kingquailflavours.com, the customer accepts these provisions and confirms that he/she is entitled to make the purchase. Quail Flavours GmbH accepts no liability for any illegal activity.
Quail Flavours GmbH endeavours to deliver goods of the highest quality. In the event of defects being reported in good time, Quail Flavours GmbH guarantees that the goods purchased by the customer will function properly and be free of defects for the statutory warranty period, which is generally two years from the date of delivery. Quail Flavours GmbH may, at its discretion, honour the guarantee by repairing the product free of charge, exchanging it for a product of equal value or refunding the purchase price. All other claims are excluded.
The warranty does not cover normal wear and tear, the consequences of improper treatment or damage by the customer or third parties, or defects caused by external circumstances. The warranty also does not cover consumables and parts subject to wear and tear.
Quail Flavours GmbH cannot provide any assurances or guarantees regarding the topicality, completeness and correctness of the data or the permanent availability of the website, its functions, integrated hyperlinks and other content.
